Analysing Kashmir: who failed, where?
It is indeed amazing that respected leaders are
still apparently unaware of how to tackle the
Kashmir-crisis. Even now, when they are giving the
impression of considering a humanitarian approach
towards it, it is difficult to take the apparent
turn in their attitude seriously for it may be a
part of their strategy to cleanse their image for
the global audience. They have no choice but to
indulge in such rhetoric. The world is not oblivious
of what is going on in Kashmir. Statistics of number
of innocent civilians having died due to firing from
state-controlled bullets together with photographs
of unarmed, young and angry people throwing stones
are sufficient for the world to see. Why have these
people been targeted by bullets? They could be
checked, pushed back by use of tear gas, water
cannons and other such means.
The governments, central led by Prime Minister
Manmohan Singh and state by Chief Minister Omar
Abdullah, seemed practically unfazed by loss of
lives till it apparently dawned on them that they
could no longer remain mute spectators to the
Kashmir crisis. Sadly, they are still in the stage
of deliberating on what moves should be taken to
“win over hearts and minds of Kashmiris”. It simply
points that they had given minimal importance to
this aspect till date. They have probably started
talking now only to improve their image and present
a better picture to the world about their policy
towards Kashmir and Kashmiris.
It is indeed ironical, that the same people who
risked their lives, ignoring the fear of falling
victim to militants’ bullets, to exercise their
right to vote, are now being targeted by
state-controlled bullets. Considering that it has
not been an easy road for Indian Kashmiris as well
as the Indian government to have reached this stage,
it is indeed tragic that the governments have failed
to pay the timely needed importance to
Kashmir-crisis. Had the correct approach being
timely used, the crisis would not have probably
reached this stage.
During the July 7 meeting of Cabinet Committee on
Security, the government opted for a “maximum
crackdown” policy against Kashmiri protestors.
During the second meeting (August 1), the CCS
decided to send more forces to the state. At the
same time, the government decided to initiate
dialogue with Kashmiri leaders and focus on a
political rather than a military solution to the
problem. This was followed by Omar visiting a
hospital in Srinagar to meet a few victims and their
relatives. Subsequently, Home Minister P.
Chidambaram responded to clarifications sought in
Rajya Sabha on Kashmir-crisis by saying that “it is
important to win the hearts and minds of people of
Jammu and Kashmir.” Omar’s visit to the hospital
apparently suggested the attempts being made by him
in this direction. The media-coverage accorded to
his visit certainly indicates that Omar did not want
this move to go unnoticed. His aim is to improve his
image, damaged considerably, having failed to
control the Kashmir-crisis.
Willingly or unwillingly, Chidambaram’s statement
exposes the harsh reality that Indian Kashmiris have
been subject to. Kashmir-issue has certainly
dominated strategic concerns of the government but
in the process lives and problems of Kashmiris have
not just been sidelined but also considerably
exploited as well as abused. The latter point is
supported by the callous manner in which young,
unarmed Kashmiris have been killed for simply
protesting against their fellow beings having been
shot dead by state-controlled bullets.
The concerned authorities apparently thought that
guns would silence Kashmiris and check others from
protesting. They weren’t probably prepared for the
frenzy with which Kashmiris would increase their
protest caring little for loss of further lives. The
Kashmiris have made a point. They have a right to
protest and so they will irrespective of whether a
few more among them fall victim to firing. It cannot
be forgotten, as mentioned earlier, that Kashmiris
have exercised their right to vote also without
fearing, of being gunned down by militants.
But as Chidambaram’s comments suggest, till now, the
Indian government had not given much importance to
initiate steps to “win the hearts and minds” of
Kashmiris. It is hoped that this statement of
Chidambaram and Omar’s visit to hospital is followed
by some constructive measures having some relevance
for Kashmiris. So far, the “crackdown” approach has
only alienated and agitated the Kashmiris further.
Bullets can never win them over and/or silence them.
The government has accepted the failure of this
approach. But this isn’t enough. A crackdown
approach is needed against those who have killed
unarmed Kashmiris. They must be punished. Besides,
relatives of those killed should be given some
compensation, even if they don’t demand these!
Why
is conscientious Indian civil society silent?
Over killings in Kashmir!
Civil
societies world over have listened to the voice of
their conscience and saved humanity from bloodbath.
They have risen against the tyranny and oppression
perpetrated by cruel and oppressive rulers. The father
of Indian nation, Gandhi ji waged struggle against
oppression irrespective of religion, caste and
ethnicity. It was struggle against oppression let
loose against human beings. He came to be known as the
founding father of the philosophy of no-violence.
Indian rulers have always exploited the slogan that
“Bharat follows the principles of Gandhi ji.”
Unfortunately the Indian rulers have
taken to the game of propaganda. They have rubbed
Gandhi ji’s principles into dust at each step. He had
clearly said:
“ Kashmiris will have to be given their
rights according to their wishes. If it means
shrinking of India in terms of territory, let it be;
if her soul is pure and just, India can become the
cradle of non-violence. If India cannot keep the
Kashmiri people satisfied, then her image will be
distorted in the eyes of world community.” (Atesh-e-Chinar)
Unfortunately, very small voices are
raised against the treatment meted out by Indian
rulers and their local agents to the people of
Kashmir. We the people of Kashmir are at a loss why
conscientious people of India are silent over the
atrocities perpetrated on us. Is it India’s fake
nationalism that prevents conscientious people from
opening their mouth? Is it because of faith?
Conscientious Indian civil society generally raises
its voice against oppression anywhere in the world but
not in Kashmir. Why is it so? Why is India bent on
distorting her image in the eyes of the whole world?
Is it because Kashmiri men, women and
children have not guns in their hands? All that they
have is one and only one slogan “What do we want?
Freedom (azaadi)”. For raising this slogan, Indian
security forces and police rain bullets on them. In no
civilized country of the world bullets are rained on
peaceful protesting mass rallies. Usually, mass
rallies are peaceful but security forces baton charge
them at every turn. They instigate the crowds to
violence. Youth pick up stones in self-defence, in
retaliation of which security forces shoot them in
their heads and chests. It seems there is deliberate
attempt to kill Kashmiri children and youth.
Mass protests are not exclusive to
India. These take place from time to time in many
countries. Security forces generally use water canons
and tear gas shells to disperse mobs. But here bullets
are rained even on womenfolk. Security forces come out
on rampage almost every day shattering window and
motor vehicle panes. Now people have begun covering
the windowpanes with metallic sheets for protection.
Indian security forces have come down
far below the level of humanism. They baton charge the
passers by. They are also using catapults to shoot
pebbles on the windowpanes of private houses and break
the glasses. “It is rumoured that in 2008 some
officers of CRPF had given the contract of breaking
the windowpanes of cars to manufacturer making glass.”
According to an estimate the security forces are
reported to have broken the screens of nearly ten
thousand cars so far. They, too, have broken
windowpanes of nearly twenty thousand private houses.
Our youth also help the Indian manufacturers of glass
by smashing windowpanes as all screens and spare parts
needed to fix a damaged vehicle are imported from
outside the state.
Parents of youngsters complain that the
police pick up teen aged boys of 12 to 13 years of age
and put them under custody in police stations and then
demand their parents to pay them a bribe of anything
between 15 and 30 thousand rupees to set their wards
free. Scarves of women are removed in public. What
more proofs than these are needed about a dehumanised
segment of society?
The rulers in Kashmir call themselves
Kashmiris but a deeper insight will reveal a
horrendous story. They are foremost in perpetrating
oppression on people. People would want to know why no
fewer than 80 persons have been killed since this
February, most of them innocent and young children
both males and females. Now things have come to a pass
that Pellet Guns used for shooting at animals are used
to fire at human beings.
We put a question to those who consider
Gandhi ji as the model of humanism. We ask them if
they think that Kashmir is a hunting ground and its
people are the hunted ones? Can the sentiment of
freedom be suppressed by throwing the youth and
children into prisons? If this sentiment could not be
suppressed for last 63 years then how can you do it
now? Omar Abdullah and his father both should
understand that whatever they have got or achieved has
been achieved only on the behest of this nation. This
does not mean that they should subject the entire
nation to violence and oppression and thus secure
their seats of power. Many chief ministers have had
heir day in the past, and Dr. Farooq Abdullah gives
statements that give an impression as if in his
infatuation for the seat of power he has become a
member of Shiv Sena.
We record here some instances showing
the circumstances in which a couple of Kashmiri youth
were done to death. The purpose is to open the eyes of
the people in India that how a claimant to democracy
spills the blood of innocent youth.
1.
Zahid Farooq aged
17 was the only brother of three sisters. On Feb 5,
2010. He was playing cricket with his friends on the
roadside, which the BSF Commandant objected to and
sent them away.. As they were going back they were
fired upon from behind and Farooq was martyred while
not a stone was pelted nor was there any rally brought
out.
2.
Inyatullah
was returning from tuition and was fired upon around
Lal Chowk. His dead body was mauled under a CRPF
truck. He was just 14 years old. This happened on 14
Jan 2010.

Wamiq
Farooq, 17 years, as returning from the house of a
relative. A tear gas shell hit him on his head and
killed him.
4.
On 11
June, Tufail Ahmad Mattoo, 17 yeas old, the only
brother of three sisters was returning from tuition.
His head was targeted for tear gas shell. His brain
got splashed on the road. What must have passed on the
parents of this martyred boy, can the defamers of the
name of Gandhi ji imagine? I could not muster courage
to go to meet the bereaved family and condole the
death. What was I to say? Is there any bigger tragedy
than a father carrying the coffin of his young son on
his shoulders?

Anantnag. His fault was that he was a Kashmiri kid.
Though Indian rulers and National Conference have
announced war against Kashmiris but civilized nations
do not kill children in war.
38.
On August 19, CRPF came out on a
rampage in Soura and started breaking windowpanes of
private houses. In one house they fired at parents and
a teen-aged girl child and its aunty. Teen-aged kid
was killed under stick blows. Four of the victims are
fighting for life in the hospital. The teenaged girl
was shot in her chest.
I have listed only 38 cases out of the
people killed so far. These killings took place since
February. All of them fall in the age group of 9 – 20.
The total number of killed computes to nearly 80.
Kashmiris put a question to the conscientious Indian
civil society. Which country’s law allows firing on
peaceful rallies of people? In which country’s law
book are we told to rain bullets and kill those who
pelt stones? Since February, 80 people have been
killed and more than 800 young persons, males, females
and children are fighting for life in hospital with
wounds. How many of them will become disabled loosing
a leg or an eye. More than a thousand people have been
sacrificed at the altar of India democracy.
During “Bharat band, Shiv Sena and BJP
destroyed property worth 64 thousand crore rupees in
Mumbai alone. They humiliated the police in public but
not a single casualty happened as a result of police
firing. Demonstrations take place in many cities and
towns of India. There is pillage and destruction by
miscreants. Stones are pelted on police. But unlike
Kashmir nowhere in these demonstrations are bullets
rained.
Naxalites can
kill 70 or 80 CRPF jawans at a time but still the
Indian people call them their own people and do not
ask for military operation against them. Against it in
Kashmir fire is opened on peaceful demonstrations and
kids of 8 or 9 years are made the target. Kashmiris
are forced to think that India has decaled war against
them?. India should remember that even a strong and
big nation has not been able to suppress a smaller
one. Viet Nam, Algeria and Afghanistan are the
examples before us.
A few days ago some unknown person sent
some threatening letters to Kashmiri Sikh community.
There was the talk of threatening to the Sikhs.
Kashmiri Sikh community has been living in harmony
with the Muslim community for many centuries in the
past. People says “It is a conspiracy by the rulers
and miscreants to communalise Kashmir’s peaceful
struggle for freedom.” Four and a half lakh Indians
came to Kashmir on Amarnth pilgrimage to visit the
lingam at the holy cave. Sixty thousand Kashmiri
Pandits participated in Khir Bhavani festival in
Tulamula. The function continued for three days and
the Kashmiris demonstrated their hospitality in full
and invited them to their homes. If a Kashmiri Pandit
dies in the valley, his Muslim friends take care of
his cremation. Therefore the Indians should try to
understand that the state rulers want to convert the
freedom struggle of Kashmiris into communal clash with
the sole motive of saving their seats of power.
Let me make an appeal to the people of
India. Do not become silent spectators of humanity in
destruction. If you are not willing to rise in support
of Kashmiris, at least rise to uphold the principles
and ideals of Gandhi Ji and the honour of India by
saving Kashmiris from being butchered. Raining bullets
on unarmed people will bring a lasting blot on India
and the ideals of Gandhi ji.

I.S.I. defies orders of Rahman Malik, punishes
Kashmiri family inspite of Bizenjo help.

Switzerland: Pakistan's infamous Inter
Services Intelligence that has been
accused of running a parallel government
in the South Asian country, is now openly
flouting the orders of the country's
interior minister.
The Hong
Kong-based Asian Human Rights Commission (A.H.R.C.)
has received information that the Pakistan
Embassy in Berne has allegedly refused the
renewal of passports to a Pakistani family
on the instructions of I.S.I. in spite of
written instructions from Interior
Minister Rahman Malik.
One
official from the embassy privately told
the family that intelligence agencies have
objections on granting the renewal of
passports to Sardar Shaukat Kashmir, who
believes in the independence and
sovereignty of Jammu and Kashmir, and
wants both Islamabad and New Delhi to keep
their hands off of Kashmir.
The
orders from Rahman Malik to the passport
authorities was flouted on the bidding of
Hassan Habib, first secretary of the
Pakistan Embassy in Berne, Switzerland.
Habib is suspected of being an I.S.I.
spook.
Since
Pakistan is a rogue state, her embassy
officials confiscated the passports of
Kashmiri's family after taking 474 Swiss
francs from them as fees for renewal of
the passports.
Kashmiri, who now lives in exile in
Switzerland, is the chairman of United
Kashmir Peoples National Party, which
advocates an independent Kashmir.
Senator
Mir Hasil Bizenjo, a friend of Kashmiri
since early 1980s when the two were
leaders of the United Students Movement at
the University of Karachi, requested
Rahman Malik for renewing the passports of
the Kashmiri family. In turn, Rahman Malik
on June 27 directed the director general
of immigration and passport to renew their
passports.
Kashmiri's mother-in-law is frail and sick
and his spouse and kids had wanted to go
visit her in Poonch.
Pakistan
passport officials sent a letter to
embassy of Pakistan at Bern on July 1,
requesting it to renew the passports.
Following that, Hassan Habib, the first
secretary at the embassy, asked the
applicants to submit the fee for renewal
of passports. The fees for passports were
paid on 5 July 2010..
During
this time the applicants were told that
clearance from Islamabad has not reached
Bern. An embassy staffer informed the
family the intelligence agencies are
reluctant to give clearance for the
renewal of passports because of Kashmiri's
activism for independence of his homeland.
Senator
Bizenjo, who Baloch nationalists allege
has strong links within the I.S.I., has
now told Kashmiri the dreaded agency was
not granting a clearance for renewal of
his family's passports.
Kashmiri
was arrested by the I.S.I., first in 1992
and a second time in 1998, and was kept
incommunicado in military torture cells
for many months. He was severely tortured
and forced to denounce the independence of
Kashmir. He was offered by the I.S.I. to
work for the agency at international
level, but he fled from Pakistan in 1999.
Many
Kashmiris prefer to work for the I.S.I.
because they are said to be paying better
rates than R.A.W. Switching loyalties from
one side to another is not uncommon among
some Kashmiris, while others play both
sides, insiders say.
However,
Shaukat Kashmiri is a committed secular
and progressive political activist.
Few
years ago, I.S.I. operatives working at
the Pakistan embassy in Switzerland
created rowdy scenes when Kashmiri went to
the Geneva Press Club to address a Press
conference, the club officials told this
reporter. The I.S.I. accuses him of
working for its arch rival R.A.W.
(Research and Analysis Wing) of India.
Interior
minister Malik, who allegedly made
millions of dollars in the Iraqi
food-for-oil scheme, was handpicked by
President Asif Ali Zardari to head the
interior ministry. Malik was once a very
low official in the Federal Investigation
Agency, but climbed the slippery pole of
promotions allegedly through alleged
bribes, manipulations and sleaze,
Pakistani media reports say. |
Independence Day & flood havoc
As the
monsoon rains have brought widespread havoc in all
parts of the country, the Independence Day of Pakistan
on Aug 14 went without any funfair. Anyway,
Gilgit-Baltistan is still long way away from the
blessing of freedom as the United Nations is not
taking any interest in fulfilling its pledge of
holding a plebiscite to decide the future of the
region in accordance with wishes of its inhabitants.
To add to this, the region has been devastated by the
natural calamity of unimaginable magnitude paralyzing
the already haggard infrastructure.According to the
chief minister Syed Mehdi Shah, about 195 villages
consisting of 2,627 houses have completely destroyed
while 122 people lost their lives in the deluges.
Standing crops of wheat, maize and potato over about
72,000 kanals were washed away.The world famous and
vital 622-km-long Karakoram Highway linking Pakistan
and China has almost lost its existence due to the
floods. The floods also washed away about 340 water
channels and damaged 63 bridges in the region. As a
result, about 86,000 people have been affected by the
natural calamity.
The chief minister has also acknowledged that after
Khyber Pakhtunkhwa, Gilgit-Baltsiatn was the worst
affected region. As a result, the area has plunged
about 30 years back in terms of development. The chief
minister has demanded Rs10 billion for rehabilitation
which may take at least five months to complete.Though
the chief minister is making hue and cry over the
destructions, his government is seen nowhere in
rescuing or helping the affected people though
political statements are coming out ferociously. On
the other hand, the Balawaristan National Front (BNF)
has issued a fact sheet according to which the
villages of Qamrah, Talas, Giyes of Diamar, Hotoo,
Rondu, Darel, Tangir, Botogah, Khinar, Thor,
Hoodoor,Babusar, Gini, Hunza Nagir, Chhamoogardh
Colony of Konodas and Skarkooi, Gilgit, Ghowadi
Baltistan, Yasen, Gulaper, Isshqaman, Damas, Ginday,
Sandhi, Hondoor, Dahrkoot, Mastuj, Booni, Garam
Chashma, Yarkhoon in Chitral, and Koli and Pattan in
Kohistan have suffered widespread destructions. It
said over 1,300 people have been killed and about 200
are still missing in these areas.More than half a
million have become homeless and nearly 50,000
families completely lost their belongings, including
land, shelter, livestock and all means of living.
This is initial information which changes with the
passage of each hour. Announcing one million rupees
for the flood devastated people of GB, the BNF
Chairman Abdul Hamid Khan asked the rulers if they can
donate some funds from their billions of rupees bank
balances for the poor people at this hour of need.
Strangely, the chief minister instead of utilizing all
government resources in aid of the displaced people is
awaiting help from outside which, if comes, is also
not likely to reach those in need. The world community
has been not forthcoming in providing aid to the flood
victims in Pakistan and Gilgit-Baltistan knowing
widespread corruption among the officials.At the
moment, the situation is such that this harshly hit
region is not protected from the looting of Pakistani
rulers and the latest example of this was seen during
the construction of spillways at the artificial lake
in Attabad where 350 million rupees were embezzled in
the name of removing some soil. In such a situation,
the international community is also perturbed on how
to provide aid to the victims of the region by saving
it from the corrupt officials.
Even no individual philanthropist or organization is
ready to donate to the affected people through these
corrupt officials, as they do not trust them. In these
circumstances, the exiled ChairmanOf the Balawaristan
National Front, Mr Abdul Hamid Khan has appealed to
the international community to come out of the
confusion and generously help the people in need. The
people of Gilgit-Baltistan do not need cash and they
should be directly provided relief items like
medicines, food, clothing, besides equipment and
material to be used in the reconstruction work. He
also said that individuals known for their integrity
and honesty in the region should be handed over the
relief items so that they can distribute them among
the affected people in a transparent manner.Another
problem is that so far there are no correct figures of
the destruction and the picture presented by the chief
minister cannot be taken as the actual picture of the
situation. According to an estimate, some one million
people have directly or indirectly been affected by
the floods while around 100 villages have lost their
existence. Roads in the region have been destroyed
while standing crops, orchard trees, water channels,
pipelines, small hydropower stations and houses have
also been washed away.In such a situation well-to-do
people in the country as well as abroad are ready to
wholeheartedly come to the help of the affected people
but again there is the issue of credibility as those
wishing to donate money think twice whether their
money would reach the people in need.
This is yet another tragedy the dishonesty of the
rulers is causing. Already the nation's wealth ahs
been stashed in foreign banks by corrupt politicians
while the masses are committing suicide due to poverty
and hunger. And when there is a natural calamity like
this, political leaders' corruption and dishonesty
becomes a stumbling block in the way of foreign aid.
At this moment, we also consider it need of the hour
that a commission consisting of people with honesty
and reputation should be formed to solicit and
distribute aid among the displaced people so that the
region is saved from the aftermath of the floods and
the affected people rehabilitated. The day of
independence this year went without any fanfare but
the people now have to think twice what Pakistan gave
them in hours of need. For the last 63 years,
Pakistani rulers have been plundering the resources of
Gilgit-Baltistan but whenever the local people face
natural calamity, Islamabad never come to their
rescue. It is need of the hour that the nation should
open its eyes and realizes the fact that what would
have been the destiny of the region had its people
been free to run their affairs in accordance with
their wishes and need. It is also hoped that the
international community will not leave the people of
Gilgit-Baltistan at the mercy of natural calamities.
Peaceful
Protest held in New York against Indian atrocities in

New York, August 15, 2010. Kashmiri
Americans held a peace rally in front of the Indian
Mission to the United Nations in New York City to ask
the world powers, “Should India Get Away With The
Flouting of International Agreements?” and “Should
India Be Granted a License For The Genocide of the
People of Kashmir?”
The demonstration was reverberating with the slogans
of “Kashmiris Demand Right to Life.” Protesters were
carrying the placards demanding “Indian Army: Quit
Kashmir”; “We Demand Self-determination”; “India Honor
UN Pledges”; “Stop Killings in Kashmir”; “Stop State
Terrorism in Kashmir”; “Kashmiris Demand Peace &
Justice”.
Dr. Ghulam Nabi
Fai, Executive Director, Kashmiri American
council/Kashmiri Center said that we demand that
Indian Government stop the killings and agree to an
impartial investigation into the recent killings, and
into the human rights violations ongoing in Kashmir
for the longest time. To resolve this outstanding
dispute between India and Pakistan over Kashmir, the
international community and the leadership of the
people of Jammu & Kashmir must be involved for lasting
peace in South Asia.
Dr. Fai
reiterated that the people of Kashmir demand an end to
the military occupation of their land by India; and
they demand what they have been pledged by both India
and Pakistan and guaranteed by the Security Council,
with the unequivocal endorsement of the United States
– demilitarization of Kashmir and a free vote
organized impartially.
Fai reminded
President Obama about his pledge that he gave to the
whole world on September 25, 2008 that, “I will
continue support of ongoing Indian Pakistani efforts
to resolve Kashmir problem in order to address the
political roots of the arms race between India and
Pakistan.” Fai emphasized that the people of Kashmir
demand that India act as a democratic nation and
respect the rule of law. They also demand that
Kashmir's right to self-determination be honored as an
inalienable right.
Sardar Sawar
Khan said that in the last two months over 60 people
have been killed by the Indian armed forces in Kashmir
in the massive riots that have taken place. This
brutal murder of ordinary people must stop
immediately. The armed forces have been silencing
innocent Kashmiris from expressing their opposition to
India's occupation of Kashmir. More than four hundred
political activists and entire leadership including
Mian Abdul Qayyum and Shabbir Shah have been
imprisoned in contravention of Article 9 of the
Universal Declaration of Human Rights. Hundreds have
been detained or arrested including Naeem Ahmed Khan
and Mohammad Yasin Malik. In such an atrocious
atmosphere of trauma, horror and chaos, your
government officials must not be delusional in
vehemently declaring that everything is under control.
Hafiz Mohammad
Sabir reminded that the Kashmir question is one of the
oldest unresolved international problems in the world.
The experience of nearly six decades has shown that it
will not go away and that an effort is urgently
required to resolve it on a durable basis. ‘Durable’,
in this context is synonymous with ‘equitable’. It is
imperative, whatever be the rights and wrongs in the
equation as far as arguments go, real populations with
a pronounced sense of identity of their own, with
their suffering and their aspirations rather than just
legal title and merit are involved.
Sardar Haleem
Khan said that the real face of India is evident truly
in Kashmir where the Indian Army during the past 20
years has killed over 100,000 men, women and children
and tortured and maimed tens of thousands. Sardar
Haleem Khan reminded President Obama what he said on
October 30, 2008 that, “We should probably try to
facilitate a better understanding between Pakistan and
India and try to resolve the Kashmir crisis.”
Others who were
present included Dr. P. Mir, Mr. Aftab Shah, Sardar
Zahid Hussain, Sardar Imtiaz Ahmed, Chowdhry Mohammad
Ishaq, Sardar Niamat Khan, Malik Nadeem Abid,
Choudhary Mohammad Akram.

Shoe-Throwing Policeman hailed as "hero" in Kashmir
SRINAGAR, India — A Muslim policeman
who flung a shoe at Indian Kashmir's chief minister
Omar Abdullah was hailed as a hero Monday, with
thousands of people descending on his home village to
congratulate his family.
Every major Indian newspaper ran front page photos of
Abdul Ahad Jan's shoe sailing over Abdullah's head, as
the minister spoke at an Indian independence day event
Sunday in Kashmir's summer capital Srinagar.
The
improvised missile failed to find its target and Jan,
who had chanted "We want freedom" and waved a black
flag -- a symbol of Kashmiri separatism -- was quickly
overpowered by bodyguards.
The
incident was captured live on television and prompted
several thousand people to descend on Jan's home
village of Ajas, about 40 kilometres (25 miles) north
of Srinagar.
Witnesses said women showered flowers on Jan's wife,
Bega Jan, and kissed and hugged her, while others beat
drums outside her home and the crowd chanted "Long
live Ahad Jan."
"What he has done is unbelievable. He has done us
proud. It was the manifestation of the anger that
every Kashmiri harbours," Merhaj-u-Din, a contractor
and part of the crowd at Ajas, told AFP by telephone.
The
celebrations, which had a distinctly anti-India
complexion, began on Sunday and continued through the
night and into Monday.
The
last two months have witnessed the worst violence in
the Muslim-majority Kashmir Valley in more than two
years.
Stone-throwing protesters opposed to Indian rule have
clashed with police on a near daily basis in Srinagar
and other towns.
Nearly 60 protesters and bystanders have been killed,
most of them young men or teenagers shot dead by
police.
Chief minister Abdullah, who heads the National
Conference, the main pro-India party in Kashmir,
sought to laugh off the incident.
"Hurling a shoe is better than hurling a stone," he
told the crowd at the independence day rally.
Abdullah has come under a lot of pressure for his
handling of the recent unrest, with many Muslims
blaming him for what they see as the disproportionate
police response to the protests.
Jan
remains in custody, and police officials were quick to
issue a statement questioning his mental state.
"He
is mentally unsound and is facing charges in a
criminal case. He has already been suspended for his
criminal activities," the statement said.
Jan's family rubbished the police version.
"He
is mentally fit. But he was disturbed by the recent
killings of civilians. He has always resisted
injustice," said Azad Jan, his relative.
Jan's name was also on the lips of supporters in
Srinagar.
"I
salute his courage for throwing a shoe at a person
responsible for killing over 50 people. Ahad Jan is
our hero," said Abdul Majid, a shopkeeper.
"His
picture should be on currency notes once we are free,"
he said.
Kashmri
needs a political solution, Dr. Manmohan Singh
NEW DELHI: The
following is the text of Prime Minister Manmohan
Singh's speech on Jammu and Kashmir:
"I welcome you today with grief in my heart, but hope
in my mind.I grieve for all those who have lost their
near and dear ones in Kashmir and in the Ladakh
region.I propose that we rise to observe a minute’s
silence to pray for the departed.
The Government of India will continue to provide
relief and other assistance and help the State
Government in providing rehabilitation for all those
affected by the unfortunate natural disaster in Ladakh.
The whole country is with the people of J&K in their
hour of sorrow.
The events in Kashmir over the past few weeks have
caused me great pain. I share the grief, the sorrow
and the sense of loss of every mother, every father,
every family and every child in Kashmir.
I can feel the pain and understand the anger and
frustration that is bringing young people out on to
the streets of Kashmir. Many of them have seen nothing
but violence and conflict in their lives and have been
scarred by suffering.
Today I wish to share with you my sense of hope for
the people of Jammu and Kashmir that I have long
nurtured.
The State is only now emerging from the
shadow of more than two decades of a deadly
insurgency, which brought only death and devastation
to the beautiful State. These were two lost decades in
the history of Jammu & Kashmir’s development.
Let us make a new beginning. I appeal
to the youth to go back to their schools and colleges
and allow classes to resume. I ask their parents: what
future is there for Kashmir if your children are not
educated?
I am convinced that the only way
forward in Jammu and Kashmir is along the path of
dialogue and reconciliation.
Our Government, more than any other
government in the past, has invested heavily in the
peace process in Kashmir. The brave rejection of
militancy by the people opened the door for us to
pursue an unprecedented and intensive internal and
external dialogue on the issues that have bedeviled
Jammu and Kashmir for six decades.
With Pakistan we took a number of bold
and indeed historic decisions. A bus service was
started. We facilitated trade across the LOC. We
facilitated arrangements for divided families to meet.
We changed the policy on allowing people representing
different shades of opinion to visit Pakistan because
we wanted to involve all sections of the people in the
peace process.
We set up a number of round-tables and
then working groups in which many of you participated
actively. Recognising the diversity of the State, we
tried to address the problems of the Kashmir valley,
Jammu and Ladakh in a comprehensive manner. We
committed unprecedented financial resources for the
State’s economic reconstruction.
I repeat all this to remind you of the
many positive things that have happened as a result of
the peace process and the sincere efforts we have made
to bring about a durable peace in Jammu & Kashmir.
Nothing will give me greater
satisfaction than to see a permanent and just
settlement of all outstanding issues that protects the
honour and self-respect of all sections of the people
of the State.
But even with the best of these
intentions, I cannot say that a complex problem that
has defied resolution for 63 years can be solved
easily or quickly. We need patience, wisdom and a
spirit of conciliation to guide us through ups and
downs in the process.
I urge the people of Jammu and Kashmir
to give peace a chance. There is a lot of hard work
that needs to be done to rebuild the State and its
institutions. We must promote economic activity and
create opportunities for employment. We must build
physical and human resource infrastructure.
But I recognize that the key to the
problem is a political solution that addresses the
alienation and emotional needs of the people. This can
only be achieved through a sustained internal and
external dialogue. We are ready for this. We are
willing to discuss all issues within the bounds of our
democratic processes and framework.
But this process can gather momentum
and yield results only if there is a prolonged peace.
I believe that the vast majority of the
people want a peaceful resolution of all issues. Let
us recognize that repeated agitations whether violent
or otherwise only obstruct this process.
The cycle of violence must now come to
an end. We must collectively ensure that no innocent
life is lost again. It is, of course, the bounden duty
of the Government to maintain law and order. We cannot
allow the turmoil to continue.
We understand the prevailing public
sentiment on the issue of the Armed Forces Special
Powers Act. Eventually the J&K Police has to take on
the burden of normal law and order duties. They do not
require special powers to discharge their functions.
We will help to accelerate the process of
strengthening and expanding the J&K Police so that
they can function independently and effectively within
the shortest possible time.
The J&K Police and other security
forces are performing an extremely challenging task in
difficult circumstances. Many of them have been
seriously injured during the past few weeks.
There are elements that are trying to
weaken the resolve of the J&K Police and trying to
undermine their lawful efforts. I urge the State
Government to take effective action to protect its
policemen and their families. We should not do
anything to demoralize the security forces.
The State Government and the Chief
Minister are making efforts to renew contact with the
people. The Central Government is fully supportive of
these efforts, which should be intensified. I believe
that all of you have the solemn duty of reaching out
to the people and reinvigorating peaceful political
activity on the ground, which is lacking today. The
youth wings of your parties should be activated. In a
democracy leaders have to listen to the voice of the
people and gain their trust and confidence.
I believe that local body elections
should be held early to increase peoples’
participation in democratic governance and to ensure
political empowerment at the grassroots level.
I would urge you to build a consensus
on a practical and realizable vision of Jammu and
Kashmir’s future. And the people have to be convinced
that this future has to be grounded in political and
economic realities of our time.
Recently, young MPs from all political
parties made an appeal to their brothers and sisters
in J&K to exercise restraint and have trust in the
power of dialogue. I fully endorse their call.
Every possible effort should be made to
reach out to the youth in Jammu and Kashmir. We must
respond in a sincere and substantive manner to their
genuine aspirations for freedom from fear and for
freedom to build for themselves a life of dignity,
security and well- being.
I assure the youth of Jammu and Kashmir
that their genuine empowerment will be accorded the
highest priority in our Jammu and Kashmir policy.
I recognize that the benefits of the
large economic reconstruction package for J&K have not
been fully felt on the ground. We will quicken the
pace of its implementation in cooperation with the
State Government.
Based on the experience gained, I am
proposing to set up an Expert Group headed by Dr. C.
Rangarajan with Shri N.R. Narayana Murthy, Shri Tarun
Das, Shri P. Nanda Kumar, Shri Shaqueel Qalander and
an official representative of the J&K Government as
members to formulate a Jobs Plan for the State,
involving both the public and the private sectors. To
increase employability in the State the Group will
interact with the National Skill Development Mission
and submit its report within three months.
But to show results of such efforts on
the ground, you will have to engage actively with the
youth and give them the sense of purpose, hope and
direction they need to make use of the many
opportunities that our economy provides.
I am optimistic about the future of
Jammu and Kashmir. India’s democracy has shown that it
has the resilience to accommodate a diversity of
aspirations and unique circumstances and the capacity
to solve complex problems.
If all sides show wisdom and restraint,
I believe that we can put the bitterness and pain of
the recent past behind us and breathe new life in to
the peace process. I urge you to carry back with you a
message of peace and reconciliation, a message of our
serious will and intent to solve all problems through
dialogue and a message of deep empathy for the youth
of Jammu and Kashmir."
Joota Khapay – shoe rule

After callous murder of former Prime Minister of
Pakistan Banazir Bhutto, people of Pakistan in
general, and people of Sindh in particular were
extremely angry and they raised certain voices which
indicated break up of Pakistan. It was at that time
Asif Zardari, husband of the deceased requested people
to calm down and coined the phrase, ‘Pakistan Khapay’
– which in Sindhi means continuation of Pakistan.
However it is interesting that ‘Khappay’ in Punjabi
and Urdu means annihilation or devastate. Asif Zardari
also speaks these languages; and his critics question
if he meant a Punjabi meaning or a Sindhi meaning when
he said ‘Pakistan Khappay’.
That aside, leaders of Pakistan Peoples Party, and
particularly Asif Zardari take pride in this slogan
and from time to time chant it in their public
rallies, especially at the end. However, luck was not
on his side in Birmingham, England where huge amount
of money was ‘invested’ to show public support for him
and his heir apparent – Bilawal Zardari.
First impediment was the strong opposition to his trip
to France and Britain when his country faced the worst
floods in the history; and almost half the country was
under water with more than 15 million people uprooted
and more than 2000 deaths. The criticism was more
sharp and effective because of extravagant expenses
when every penny was needed to feed the uprooted
people.
As a result of this strong criticism he had to
make changes to the planned ‘launch’ his son, Bilwal
in politics. And to add salt to wounds, a Kashmiri
from Sensah, Kotli (Pakistani Occupied Kashmir) hurled
two shoes at Asif Zardari to express his anger against
his trip and his Kashmir policy. The shoes did not hit
him but the insult and anger it generated was so
overwhelming that Asif Zardari had to finish his
speech abruptly and without the chant of ‘Pakistan
Khapay’ and ‘PPP Khapay’.
This incident attracted so much interest in the media
that both Asif Zardari and shoe thrower, Sardar
Shameem Khan, immediately became part of history,
although Asif Zardari is already very controversial
and historic figure, but loathed and hated at the same
time. After this incident he has become historic for
abandoning his people in trouble and for being in a
same league with the former President Bush.
‘The News’ correspondent came out with an interesting
headline:
‘Zardari joins the Shoe Club with Bush’.
What happened inside the
hall was supported by hundreds of people protesting
outside the hall against the visit. According to ‘The
News’ report,
‘Some
demonstrators held up shoes to pictures of Zardari,
while others held placards reading, “1000s dying,
president is holidaying”, “Thousands killed, millions
homeless, what president is laughing for?” and “Are
the Zardaris enjoying England while Pakistan drowns?”
In line with the PPP tradition the
party leaders have come out in force telling white
lies and totally denying any knowledge of the incident
of shoe throwing; although initially Qamar Zaman Qaira,
Minister Information condemned the incident. He
confirmed the incident took place. Hundreds of people
which include dozens of journalists witnessed the
incident; and yet PPP leaders have nerve to deny any
knowledge of it.
Later on the
shoe thrower was located by Geo TV in Coventry where
he lives, and his live interview was broadcasted late
at night. This time the government behaved like a
totalitarian government and stopped transmission of
the Geo TV and ARY Digital; and despite this clear
evidence the PPP leaders were brave enough to tell
white lies and still continued with the denial of shoe
throwing incident.
Because of
the political culture in Pakistan, people try to find
a conspiracy behind every incident. Many think the
incident was managed by the Pakistani agencies; and
fingers are being pointed to the elite agency of
Pakistan. The purpose of this plot, according to the
conspiracy theory, was to defame the President Asif
Zaradri and destabilise his government, as if Asif
Zardari is famous and his government is stable.
Some critics
think opposition parties were behind this conspiracy
and that is why Baber Awan, Minister of Law threatened
that PPP workers also wear two shoes, implying that in
future they will also target opposition politicians
with shoes.
Some allege that
Lord Nazir
Ahmed, because of his close contacts with the
Pakistani agencies, was behind this shoe throwing
incident and the demonstration outside. In view of
these people, Lord Nazir Ahmed has a clear anti Asif
Zardari stance and close working relationship with the
agencies and he managed all this while keeping himself
out of this
However in
my considered opinion all the above views are wrong.
The demonstration was arranged by different political
parties which included Kashmiri nationalist parties;
and the shoe throwing incident was an act of one
individual, although some believe that there was a
meeting in Midlands one night before the rally in
which this thing was discussed.
The man
behind the incident, Sardar Shameem Khan is a friend
of Mohammed Nazam Bhatti, President of Kashmir
National Party in Britain. Nazam Bhatti confirms that
there was no one behind Sardar Shameem Khan.
Opposition parties, Pakistani agencies and Lord Nazir
Ahmed have no role in this incident. Nazam Bhatti is
the one who arranged all the interviews of Shameem
Khan, including exclusive interview with Murtaza Shah,
of the Geo TV.
Some people
point out that this incident should not have taken
place because it has brought shame to Pakistan as
well; after all, Asif Zardari was an elected President
of Pakistan. But one could argue that the target was
not the President of Pakistan but Co Chairman of PPP,
who holds two posts, despite clear conflict of
interest.
The PPP
leaders always take a similar position. Whenever Asif
Zardari makes a blunder in his speech; and people
protest that as a President he should be neutral and
must not make a partisan speech, his followers claim
this speech was delivered as a PPP Co Chairman.
Anyway,
Nazam Bhatti says Shameem Khan belonged to the PPP,
but he was angry with Asif Zardari and his government,
because of what they have done to Pakistan and for
their wrong Kashmir policy.
He cautioned
Azad Kashmiri leaders to ‘stop shoe licking of
Pakistani leaders’ and work in interest of Kashmiri
people, else they will not be allowed to hold any
public meetings in Britain in future.
Shameem Khan
thinks people should not tolerate this corruption and
looting by those who hold public office, and they must
be held accountable for their actions. He says best
way forward is that public should take off their shoes
and discipline these leaders who have looted the
public funds. He says like the slogan, ‘Pakistan
khapay’ we should say ‘Joota Khapay’; and this
campaign against these leaders must continue until
they change themselves and become servants of the
people in real sense.
He says,
until this transformation takes place, people should
not give them any funds because these funds will never
reach where they are needed; and these leaders and
corrupt officials will misappropriate these funds, as
they did at the time of earthquake and will become
millionaires.
Shameem Khan
says, until such time people should give funds to
those who are tried and trusted in the field of
welfare and service to the needy. He said people
should give funds to Kashmir Awami Foundation and Edhi
Foundation.
JKNLC Gulpur (Kotli) Held its First Convention on 8th
July, 10
Rawalpindi, August 09: Jammu Kashmir
National Liberation Conference (JKNLC) Gulpur (Kotli)
held its first, impressive and elaborate convention
yesterday, which was presided by Mr. Javed Zafar,
central V. President of JKNLC and a local leader and
was conducted by Mr. Faisal Kashmiri, while Mr. Arif
Shahid, President of JKNLC, was the chief guest. Since
other nationalist parties were also invited, those who
spoke, besides the chair and the chief guest, on the
occasion were: Shaukat Maqbool Butt (addressed on
telephone), Mr. Ramzan Datt, Advocate, Mir Siddique,
Raja Abdul Qayyum, Mr. Azhar Kashar, Qayyum Ch.,
Tabarik Syed, Prof. MARK Khaleeque (JKNAP), Mr. Taifur
(JKPNP) and some others.
The speakers congratulated the local leadership of
JKNLC of Gulpur for putting such a hard work in
political and ideological direction by arranging such
a successful convention for the first time, especially
with reference to nationalist camp, in Gulpur's
history. They said that JKNLC believed in freedom of
Jammu Kashmir to establish a democratic and secular
state in it after its freedom, and was struggling for
this purpose. They exposed and condemned Pakistan's
govt. and its puppets in Pakistan-Administered-Jammu
Kashmir (PAJK) and Occupied Gilgit-Baltistan (OGB) for
their superficial, selfish and out-dated Kashmir
policy through which she had converted these
territories into her colonies. They said that JKNLC
was serious and meant business to translate its ideals
into reality, and would continue this struggle till
achievement of the mission of free, democratic,
secular and progressive Jammu Kashmir State.
Earlier, the local units of Gulpur Jammu Kashmir
National Liberation Conference (JKNLC) and Jammu
Kashmir National Students Conference (JKNLC) were also
announced and given oath by the President of JKNLC,
Mr. Arif Shahid, who congratulated them and expected
sincerity, honesty, dedication and diligence of them
for the cause of the party.
Before concluding, the book of Raja Abdul Qayyum
(incharge diplomatic wing of JKNLC) – " Dastan-e-Azam"
was launched and introduced by Raja Aftab, President
of `Sultani Organization', which was based on the
story of his imprisonment of 22 years in England on
the allegation of murder of late Mr. Mahatre, a member
of Indian diplomatic service, during Ist week of Feb,
84. The launching ceremony was hailed and welcomed by
the participants of the convention.
Kashmir a helpless region, the
story on other side of LOC: By Javed Inayat
Pakistani side of Kashmir region has
been facing enormous problems. Local state
administration has not been functioning since it was
set up after overthrowing ‘’ republic of Kashmir’’ in
1947 but since Oct, 2005 killer earthquake hit this
region state administration was badly exposed.
Apparently local govt. has been elected by voters but
it authority is less than a municipal committee. POK
state assembly is a legislative assembly but it has no
jurisdiction to make a law or amend a law by itself.
It is the only legislative assembly in the world which
has been elected by local people but it has been
controlled by unelected, non Kashmiri dignitaries ,
such as minister of Kashmir affairs, chairman Kashmir
council, who happened to be Pakistani PM, chief
secretary is one of the third top most administrators,
who has more authority than POK PM. Ministry of
Kashmir affairs is one of the Pakistani state federal
ministries, its minister would be acting as a federal
minister, who always have to be elected from Pakistan
as a member of national assembly. Neither Kashmiris
can elect him nor can replace him. He is the one who
can be called a king maker in POK region including
occupied Gilgit Baltistan. He makes and breaks the POK
Govts. On behalf of state secret services including
Army GOC Murree. One of them can decide who will run
the show in POK and then circus can begin. POK region
has been ruled by its interim constitution which
popularly called act 1974. According this document,
all powers lie in Islamabad, even Pakistani PM can
dismiss POK PM or entire Govt. it depends on his mood
and his background, if he is a military dictator, most
probably he would like to dismiss whole POK Govt, and
if he is a civilian he might stay only dismissing PM
or president of POK. This shameful drama has been
going on since 6 decades in POK region.
Last four years
Islamabad had changed 4 PMs in POK region, only reason
was federal minister may not liked one or the
Pakistani PM or president may not liked one or the
other POK PM. Two weeks ago third PM Raja Farooq
Haider was ousted and fourth one sardar Attique khan
was installed by Islamabad. Unfortunately, same
Attique Khan was removed from power by his own party
through no confidence motion against him, while
charging him that he was involved in worst kind of
corruption, mismanagement, misuse of state power,
nepotism but shaming every citizen in POK last week,
not only Muslim conference again given him PM mandate
but more than 10 opposition MLAs also gave him vote.
Pakistani state has reached on its suicide point but
POK region has drown in to a lowest of the lower level
of humanity by Pakistani official state politicians
who have been involved in POK politics. Pok
politicians have proved once again that they are not
normal human beings let alone representatives of
people. What these MLAs have done with this so called
POK assembly no one can even think of doing that level
cheapest politics and opportunism Attique Khan has
shown this time again means crossed over all his
father,s limits also. I do believe that POK people
must be rethinking that a man who has been deceiving
POK people half a century has produced a leader for
POK people two steps ahead of him, who has no morals,
no political norms, no vision and most importantly no
shame at all doing this kind of so cheap politics with
the help of corrupt Pakistani federal minister, state
secret agencies and begging for shameful PM position.
It was nice to see on media that Raja Farooq haider
ousted PM of POK has been exposing his own party
colleagues and assembly members Pakistani state role.
Unfortunately, POK leaders always started talking
about citizen rights when they got kicked out from
power, humiliated and shown them their real position.
There have been
very serious cracks appeared on the surface among POK
ruling class sections this time. POK state has gone in
to a very serious political economic and social
crisis, so that Pakistani state is trying to down play
this deep rooted crisis with changing PMs again and
again to divert attention from real situation. POK
region is going out of hand due to distance between
artificial created ruling class by Pakistani state in
POK and masses. Overwhelming majority of POK
population thinks that they have no Govt. nor they
feel comfortable with their politicians because they
have been controlled by Pakistani state one way or the
other. Most of them think that they have never been
representative Govt in Muzaffrabad since Pakistani
state had overthrown Republic of Kashmir on 24th Oct,
1947 nor their vote ever have been respected in terms
of dismissing their elected Govts by Pakistani rulers.
Now last 2 decades new generation has grown up in POK
region and this generation has been observing its own
conflicts with local colonial administration.
Pakistani role has been exposed by local political
groups, intellectuals, students organizations have
been on the forefront of this new political
development in the region. Since Pakistani state has
launched a Jihadi project across the border, her role
in Kashmir dispute has seen more doubtfully by POK
youth because the country which has been demanding
rights for those under Indian occupation but not
granting the same rights to those Kashmiris who have
been under her occupation. Valley based Jihadi
movement has failed to radicalize POK youth even
religious groups from POK having hard time facing POK
youth. New political developments in POK region are
more reasoning based, more relevant to local
situation, more appealing to educated youth, most of
them have no future living with Pakistani state,
therefore, new political movement is emerging from POK
region and it will be only POK centric. POK region has
more than 70% education, highest than any Pakistani
area this time but there is no industry, no
professional institutions, no medical school, no
business school, no job opportunities for POK youth.
POK region has 4 million populations but 47 % has
migrated since last 40 years due to lack of job
opportunities in the region. After 2005 earthquake,
economic situation has worsened due to Pakistani state
official’s involvement in severe corruption and
inability of local state administration. Now POK
region has very serious economical conditions and
state administration has become irrelevant. Local
youth may not be able to continue peaceful political
struggle if Pakistani federal ministers keep
dismissing our PMs after 10 months. Pakistani
involvement in POK affairs has been very
counterproductive and it has damaged every level of
trust among POK people.
BJP to hold 'Save Jammu &

Day' on August 21

News! Demanding the restoration of normalcy in
J&K, the BJP party has announced that it will hold
'Save Jammu &
Kashmir
Day' across the country, on August 21. The
party urged PM Dr. Manmohan Singh to intervene.
The party has decided to raise a voice
against the law and order situations there and will
observe August 21 as Jammu and
Kashmir
Bachao Diwas across the country.
On this day, the party is going to hold public
meetings at the party headquarters in state capitals,
and Central unit leaders will be attending the met.
The BJP General Secretary Ananth Kumar has alleged and
criticized that under the Congress-ruled UPA
government the state has moved from "separate status
(under Article 370) to separatism”.
He has demanded not to decrease the Army and security
forces in Jammu and
Kashmir
and also the government should take no steps to
demoralize the security forces deployed in the state.
The matter was also debated in the Rajya Sabha, where
the party said that the state is slipping out of
control for which it has warned the government for its
negligence of proper law and order in the state ,and
if the government doesn’t take steps then this stage
would further "dilute the sovereignty" of the region.

NOT TAKE BOLD STEPS TO ADDRESS THE GRIEVANCES OF THE
KASHMIRIS, THERE'S NO TELLING WHERE THE NEXT ERUPTION
WILL TAKE US, WRITES SIDDHARTH VARDARAJAN
WHATEVER his other failings,
Chief Minister Omar Abdullah deserves praise for
acknowledging that the protests which have rocked the
Kashmir valley these past few weeks are ‘leaderless' and
not the product of manipulation by some hidden
individual or group.
This admission has been difficult for the authorities to
make because its implications are unpleasant, perhaps
even frightening. In security terms, the absence of a
central nervous system means the expanding body of
protest cannot be controlled by arresting individual
leaders. And in political terms, the spectre of
leaderless revolt makes the offer of ‘dialogue' or the
naming of a ‘special envoy' for Kashmir — proposals
which might have made sense last year or even last month
— seem completely and utterly pointless today.
Ever since the current phase of disturbances began,
intelligence officials have been wasting precious time
convincing the leadership and public of India that the
protests are solely or mostly the handiwork of agent
provocateurs. So we have been told of the role of the
Lashkar-e-Taiba and ISI, of the ‘daily wage of Rs. 200'
— and even narcotics — being given to stone pelters. A
few weeks back, an audio recording of a supposedly
incriminating telephone call was leaked to the media
along with a misleading transcript suggesting the
Geelani faction of the Hurriyat was behind the upsurge.
Now, our TV channels have “learned” from their “sources”
that the protests will continue till President Obama's
visit in November.
Central to this delusional narrative of manipulated
protest is the idea that the disturbances are confined
to just a few pockets in the valley. Last week, Union
Home Minister P. Chidambaram told reporters the problem
was limited to Srinagar and two other towns. No doubt,
some areas like downtown Srinagar, Sopore and Baramulla
were in the ‘vanguard' but one of the reasons the
protests spread was popular frustration over the way in
which the authenticity of mass sentiment was being
dismissed by the government. For the women who came on
to the streets with their pots and pans and even stones,
or the youths who set up spontaneous blood donation
camps to help those injured in the demonstrations, this
attempt to strip their protest of both legitimacy and
agency was yet another provocation.
In the face of this mass upsurge, Prime Minister
Manmohan Singh has two options. He can declare, like the
party apparatchiks in Brecht's poem, that since the
people have thrown away the confidence of the
government, it is time for the government to dissolve
the people and elect another. Or he can admit, without
prevarication or equivocation, that his government has
thrown away the confidence of the ordinary Kashmiri.
This was not the way things looked in January 2009, when
Omar Abdullah became chief minister. Assembly elections
had gone off well. And though turnout in Srinagar and
other towns was low, there was goodwill for the young
leader. Of course, those who knew the state well had
warned the Centre not to treat the election as an end in
itself. The ‘masla-e-Kashmir' remained on the table and
the people wanted it resolved. Unfortunately, the Centre
failed to recognise this.
It is too early to gauge the reaction to Mr. Abdullah's
promise of a “political package” once normalcy is
restored. But the people have thronged the streets are
likely to ask why this package — which the chief
minister himself admitted was “long in the pipeline” —
was never delivered for all the months normalcy
prevailed. What came in the way of amending the Armed
Forces (Special Powers) Act? Of ensuring there was zero
tolerance for human rights violations? Of strengthening
the “ongoing peace process both internally and
externally”, as the all-party meeting in Srinagar
earlier this month reminded the Centre to do?
At the heart of this missing package is the Centre's
failure to craft a new security and political strategy
for a situation where militancy no longer poses the
threat it once did. The security forces in the valley
continue to operate with an expansive mandate that is
not commensurate with military necessity. Even if
civilian deaths are less than before, the public's
capacity to tolerate ‘collateral damage' when it is
officially said that militancy has ended and normalcy
has returned is also much less than before.
The immediate trigger for the current phase of protests
was the death of 17-year-old Tufail Mattoo, who was
killed by a tear gas canister which struck his head
during a protest in Srinagar in June against the Machhil
fake encounter of April 30. Many observers have blamed
his death — and the deaths of other young men since then
— on the security forces lacking the training and means
for non-lethal crowd control. Tear gas, rubber bullets
and water cannon are used all over the world in
situations where protests turn violent but in India,
live ammunition seems to be the first and only line of
defence. Even tear gas canisters are so poorly designed
here that they lead to fatalities.
Whatever the immediate cause, however, it is also safe
to say that young Tufail died as a direct result of
Machhil. Though the Army has arrested the soldiers
responsible for the fake encounter, the only reason they
had the nerve to commit such a heinous crime was because
they were confident they would get away with it. And at
the root of that confidence is Pathribal, the notorious
fake encounter of 2000. The army officers involved in
the kidnapping and murder of five Kashmiri civilians
there continue to be at liberty despite being
charge-sheeted by the CBI. The Ministry of Defence has
refused to grant sanction for their prosecution and has
taken the matter all the way to the Supreme Court in an
effort to ensure its men do not face trial. What was the
message that went out as a result?
Had the Centre made an example of the rotten apples that
have spoiled the reputation of the Army instead of
protecting them all these years, the Machhil encounter
might never have happened. Tufail would not be dead and
angry mobs would not be attacking police stations and
government buildings.
Impunity for the few has directly endangered the lives
of all policemen and paramilitary personnel stationed in
Kashmir. There is a lesson in this, surely, for those
who say punishing the guilty will lower the morale of
the security forces.
Mr. Abdullah may not be the best administrator but his
biggest handicap as chief minister has been the Centre's
refusal to address the ordinary Kashmiri's concerns
about the over-securitsation of the state. Today, when
he is being forced to induct an even greater number of
troops into the valley, the Chief Minister's ability to
push for a political package built around
demilitarisation is close to zero.
At the Centre's urging, Mr. Abdullah made a televised
speech to his people. His words do not appear to have
made any difference. Nor could they, when the crisis
staring us in the face is of national and international
proportions. Today, the burden of our past sins in
Kashmir has come crashing down like hailstones. Precious
time is being frittered in thinking of ways to turn the
clock back. Sending in more forces to shoot more
protesters, changing the chief minister, imposing
Governor's Rule — all of these are part of the reliquary
of failed statecraft. We are where we are because these
policies never worked.
The Prime Minister can forget about the Commonwealth
Games, AfPak and other issues. Kashmir is where his
leadership is urgently required. The Indian state
successfully overcame the challenge posed by terrorism
and militancy. But a people in ferment cannot be dealt
with the same way. Manmohan Singh must take bold steps
to demonstrate his willingness to address the grievances
of ordinary Kashmiris. He should not insult their
sentiments by talking of economic packages, roundtable
conferences and all-party talks.
He should unreservedly express regret for the deaths
that have occurred these past few weeks. He should
admit, in frankness and humility, the Indian state's
failure to deliver justice all these years. And he
should ask the people of Kashmir for a chance to make
amends. There is still no guarantee the lava of public
anger which is flowing will cool. But if he doesn't make
an all-out effort to create some political space today,
there is no telling where the next eruption in the
valley will take us.

Offer on a gun barrel
Omar’s peace offer
laced with arrogant self-righteousness lacks logic as
well as credibility
Within less than a week’s time after the state
government had appointed an inquiry commission to probe
killing of seventeen persons in police firing since
second week of June, nearly 30 more victims have been
added to the gruesome list in less than a week’s time. A
record indeed! Chief Minister Omar Abdullah could not
have been more insensitive to underlying human tragedy
than when he claimed ‘credit’ for managing to keep the
number ‘below’ that recorded ‘under similar
circumstances in 2008’ Amarnath land row agitation. When
the innocent human beings felled by the bullets fired
upon them by the ‘security’ forces of their own state
are sought to be reduced to cold statistics for
comparison it speaks volumes about the character of our
rulers. Instead of hanging their heads in shame and
accepting their moral responsibility for the carnage
those responsible for it have the cheek to turn around
and claim credit for what, by most charitable
definition, can only be described as ‘merciful
butchery’. This is most reprehensible. The coalition
government’s record in this regard will remain forever
stained with the blood of innocent citizens including
children and women.
Omar Abdullah, while speaking in New Delhi after his
meetings with the central government leaders on Monday,
unfortunately failed to reflect the spirit of
reconciliation even as he was labouring on his
‘commitment’ to initiate political measures after
restoration of normalcy in the Kashmir Valley. He spoke
the language of power and arrogance of power when he
threatened his own people ‘there will be consequences’
if protestors did not behave or failed to remain
peaceful. As if to clear any doubts on this score, the
chief minister announced that he had sought additional
forces from the centre and that contingents of Rapid
Action Force (RAF) were on the way to Kashmir. Lauding
the ‘maximum restraint’ being exercised by his
‘over-stretched security forces, Omar warned that
restraint is not a one-way affair. On the face of it,
Omar’s terminology is unexceptionable. Only that he
forgot to remind himself of this norm when the trouble
first broke out in the month of June with the killing of
an innocent school boy whose life was snuffed out as he
was returning from a coaching class. Thereafter it
became a vicious cycle of violence. All that the chief
minister was supposed to do at that crucial moment was
to share the grief of the victim’s family which lost its
only son and ordered a credible inquiry into the
incident. The government’s failure to honour even this
elemental part of its obligation led to a chain of gory
events resulting in staggering bloodshed. Talking of the
‘restraint’ the CM could not be ignorant of a woman in
Magharmal Bagh in Srinagar being shot dead right inside
her house, a 9 year old boy being fired upon and then
beaten up to his death at Aloochi Bagh or three boys
being shot dead in the compound of a house at Anantnag.
‘Consequences’ are there for all to see. Omar is right
in saying that there would be consequences of ignoring
restraint. But he only sees one side of it and his
government continues to be blind to seeing its other
side. This type of pontification is devoid of logic and
honesty. The situation could not have worsened to this
extent if the CM had only remembered to practice what he
is today preaching to others in retrospect.
The same arrogant refrain runs across the chief
minister’s reiteration of the offer of ‘political
package’ and ‘dialogue’ with alienated segments of
public opinion in the Valley. Firstly he wants the
victims of his government’s repression and oppression to
bail him out by defusing the current volatile situation
and then sit with him to discuss non-issues. Nobody is
going to be taken in by such offers. When the atmosphere
in the state was calm and conducive Omar wasted his
time. He behaved with arrogance; ignoring his own party
rank and file, ignoring mainstream opposition and going
after the separatist leaders and their followers. At no
point did he show any sign of appetite for dialogue. His
immaturity made him believe into his fantasies until he
found himself, his government, his own party and the
entire mainstream spectrum pushed into a corner. Where
on earth is there any scope for a purposeful dialogue
after all this destructive work done by the coalition
government under his leadership? Omar’s message from New
Delhi lacks conviction as well as credibility. It is
destined to be lost as a cry in wilderness. Certainly,
there must be a better way of going about it than
couching the language of peace in arrogant jingoism on
the strength of the state’s armed might.

Undisputed Tragedy of
Kashmir
Several Pakistani intellectuals who had
descended on Washington DC to attend 11th
International Kashmir Peace Conference (July 28-29,
2010) were neither intellectuals nor interested in
peace.
Wasting time and resources, Pakistani representatives
(with very few exceptions) read from a script crafted
decades ago at the GHQ – slightly changing words.
I bet if you took the text of their
speeches and ran it through sophisticated software to
check intellectual integrity you will find an
abundance of plagiarisms.
Negativity of approach was so overwhelming that
‘Kashmir issue’ lost more currency instead of gaining
ground. With WikiLeaks dominating the mind share,
American media barely covered the event.
In discussions, both private and public, Pakistani
speakers demanded that America must broker a
settlement in exchange for the ‘sacrifices’ Pakistan
has made in war against terror. All accused America of
betraying Pakistan, an ally of nearly 60 years. “Under
Bush administration, the neo-cons have steered US
towards India and away from Pakistan,” a Pakistani
intellectual claimed. And, he explained that is
“because Jewish-Hindu lobby dominates policy making in
Washington.”
In abundance was child like envy over
growing India-US ties, and old and tired threats that
if Kashmir issue is not resolved there will be no
peace in either Afghanistan or India. Unfortunately,
many who “spoke for” Kashmir lacked intellectual
depth, and understanding of imperatives that drive
strategic diplomatic ties.
All agree that last decade has been a
truly transformational one in the India- U.S ties but
cannot explain why. In November last year when Prime
Minister Manmohan Singh came to Washington on the
first State visit of the new U.S. Administration, it
was a clear indication that Democrats on the Hill will
continue to see India through the prism it first
located during the BJP government. India’s proverbial
‘openness’ has yielded rich dividends in terms of
cooperation in many areas, underscoring the vitality
and the relevance of India-US strategic partnership.
It was therefore, not surprising when
Obama administration recalibrated her earlier stance
of bracketing “Afghanistan, India, and Pakistan”
together. Afghanistan and Pakistan are ‘pain points’
but Washington sees India as a center of influence in
the 21st century.
A Pakistani diplomat had whispered in
my ears that Americans realize that they cannot “clean
the mess in Afghanistan without our help. And of
course we want a solution to Kashmir issue in return.”
A friend who also spoke at the
conference claimed that Washington is finally
realizing that India and Pakistan are equally
important in that region. I beg to differ!
I would urge you to look at the
transformation of DC-Delhi relationship against the
backdrop of India’s initiatives to reform its economy
and the geopolitical changes in the post-Cold War
world.
Indian officials would claim that their
ties with US are primarily due to shared values of
democracy, pluralism, tolerance, and respect for
fundamental freedoms. You may not agree with this
assertion – I don’t buy this argument in entirety
either.
But we can’t deny that growing economic
linkages and people-to- people contact between India
and US are real. Over the last two decades, Indian and
American businesses have formed strong and mutually
beneficial partnerships touching the lives of ordinary
people; a fairly balanced trade in goods and services
has grown astronomically.
Most importantly, Pakistanis tend to
forget that both Indians and Americans share an
increasing convergence of interests on major global
issues.
By using the 11th Kashmir moot in
Washington DC as a venting session, Pakistanis
basically lost an opportunity to build the zone of
trust. Kashmir issue is real, and solution will emerge
only when Pakistan and India stop exploiting the
people of Kashmir. It has become a financial drain for
India and Pakistani strategy to use rag-tag army of
fundamentalists has cost Pakistan in orders of
magnitude more than anyone every estimated.
There is a broad-based political
support both in India and Pakistan to finally let the
people of Kashmir speak for themselves but these
pseudo intellectuals who had come to attend the
conference are not ready to move on.
Instead of allowing the GHQ to drive
India-centric foreign policy, we will do Pakistan and
Kashmir more justice if we were to expand our
diplomatic orbit. If we establish mutually beneficial
economic ties with Brazil and Venezuela, South Africa
and Kenya, Chile and Bolivia, Malaysia and Indonesia –
Pakistan will have more allies in the world and we
will not have to run to Washington DC to beg Americans
for stewardship on Kashmir issue.
India today has free pass to commit
unthinkable violence on Kashmiri people partially
because we have lost all legitimacy. How can we raise
our voices and wave our fists when it is an undisputed
fact that Pakistan army used rag-tag warriors of
Lashkar-e-Taiba, the Jaish-e- Mohammed, the Taliban,
and more with intent to make India bleed in Kashmir?
What moral grounds do we stand on?
We can’t be running to the US or Israel
for support – we must build a broad based
multi-lateral framework of developing nations to
counter Indian belligerence in Kashmir. We must stop
thinking about Kashmir as a ‘disputed territory’ and
start working for the safety and security – both
physical and financial of the people of Kashmir.
No cause can justify terrorism –
Kashmir is no exception. Both India and Pakistan have
a vital interest in defeating terrorism and in this
context, our bilateral cooperation on terrorism is
crucial.
Most importantly- both India and Pakistan should
immediately cease terrorizing Kashmiri people.

Sir,
I would
like to draw your attention to the turbulent situation
in Jammu & Kashmir. In reaction to unprovoked killings
by Indian Security forces, the people in Kashmir,
especially the youth have been staging demonstrations
and protests for the past two months. During these
peaceful demonstrations, the Indian Security forces have
not abstained from using bullets to assassinate people's
democratic rights. This has resulted in the fact that
during the ongoing agitation part of the youth has been
compelled to display their dissatisfaction and anger by
stone pelting. But in response to their stone pelting
the Indian Security forces have used bullets, which has
resulted in the death of more than 30 people, including
women and children. The use of extensive and
disproportional force by the Indian Security forces has
fueled the anger among the people and this turbulent
situation seems to have become a vicious circle which
will only result in more innocent deaths.
The use of force by security forces has not been limited
to demonstrations, but they even entered homes and
embarked on ruthless rampages, which only deteriorates
the situation. Zahid Farooq (17 years), Tufail Mattoo
(17 years) and Inayat Khan (16 years) were not part of
any demonstration or agitation, but were either playing
cricket or on their way attending tuition, but they were
killed ruthlessly by tear gas shells and bullets fired
upon them by Indian Security forces, without any reason
or provocation whatsoever. The brain of one of these
kids was blown out by a tear gas canister.
Even
during these atrocities, I am proud to state that my
Kashmiri people defied communalism and portrayed honesty
and Kashmiriyat as they welcomed this year's Hindu
pilgrimage and made sure that none of the pilgrims were
hurt or refrained from performing their religious
duties. On the other hand the Indian Security forces
have forbidden the Kashmiri people from performing their
religious duties, as the doors of the largest Mosque in
Kashmir have remained closed for the last month amidst
curfew.
A 24-hour curfew has been imposed by the Government
which has made life come to a standstill. Educational
institutions, businesses and hospitals have remained
closed for over a month now. Patients are deprived from
medical attention. People are frustrated as they have
been confined to their homes and scarcity of essential
needs has been prevailing. Corruption has been
flourishing, because innocent youth is being arrested
and extorted for money and otherwise charge sheeted with
serious crimes.
Even
local Ministers have said that the Indian Security
forces are out of their control. The Indian
establishment and intellectual class, including the
Indian Prime Minister, Indian President, Indian Home
Minister and Indian media have been silent over these
atrocities and numb to people's cries for justice. Local
Kashmiri media has been banned and local journalists are
assailed. The justice system has collapsed as the courts
have clearly been degraded to toothless tigers.
Thousands of detainees are cleared by courts of charges,
but as soon as they are released, they are again
arrested by the police and detained under draconian laws
like Public Safety Act (PSA) and Armed Forces Special
Powers Act (AFSPA). These laws have their roots in the
Defence of India Act (DIA) which was enacted during the
British rule. PSA is actually a more rigorous form of
the DIA that was described, as a draconian and a black
law enacted by Britishers to suppress Indian freedom
struggle, by the founding father of Indian democracy
Mahatma Ghandi.
My
people are treated like colonial slaves and expropriated
of their freedom and inalienable rights. As your
Excellency is the safeguard and trustee of Human Rights
and Liberty, I, on behalf of the enslaved Kashmiri
nation, humbly request your Excellency to take note of
the grave human rights violations in Kashmir and address
the reign of state terrorism unleashed upon us. If
addressed, the below mentioned points could prove to be
a foundation in resolving the decades old Kashmir issue:
1) Revocation of draconian laws like AFSPA and PSA.
2) Demilitarization of Jammu & Kashmir and removal of
bunkers and military establishments.
3) Release of all political prisoners.
4) Clarity on disappearances and creation of an enquiry
and monitoring system into these disappearances under
the supervision of the UN.
5) Rehabilitation and opportunity of pursuit of
happiness for all those who have abandoned Violence.
6) Rehabilitation and creation of a mechanism to bring
back all Kashmiris who left their motherland during the
20-years of violence, including Kashmiri Pandits.
Dear
Excellency, the above mentioned points are not a
solution to the Kashmir problem, but they could provide
the Kashmiri people a breeze of peace and prove to be
essential in creating an atmosphere and fundament among
the concerned parties, in order to make way for a
lasting solution to this issue. Your Excellency, the
people of Kashmir have been suffering for more than half
of a century and are in desperate need of justice and
rejuvenation of their self-esteem.
Your
Excellency, I hope that you will bring your personal
influence to bear to initiate a peace process, which
will include the people of Jammu & Kashmir, in order to
reach a peaceful settlement which will be based on the
incontestable principles of justice.

Pakistan-Administered –Jammu Kashmir(PAJK).
However, despite its claim
of being political, Social and intellectual platform,
its main function would remain intellectual and
educative and would work through conferences, seminars
and workshops etc.Instead pf public meetings processions
and protest as the custom the territory and around.
The today’s seminar
“Act-1974 a Document of Slavery-Incomplete Freedom”
is in the line of
our mission. We want to purge it of all symbols, signs
and sections, which render this state as a colony. For
that, side by side with suggesting amendments in the
particular sections, we are also going to suggest
changes in the main features of this Act. In fact, we
like to improve it from an act to Constuition, which
needs a constituent assembly and we have already
demanded that. But needs a long and different type of
struggle, which continue. In the meantime, we are
raising our voice with the voice of Prime Minister of
PAJK, who has been harping on amending this Act. We know
that he has dramatized the situation unnecessarily, for
he can change most of sections just in the joint sitting
with simple Majority, which he can muster with the help
of his own party.
Any way, we want to be
helpful to him, at least politically, by highlighting
the required changes. Firstly, we would like to change
this act into a Constitution by electing a new
constituent assembly meant for this purpose. Secondly,
if the puppets of PAJK want to remain always under heavy
hand of master, they should say so clearly and
unambiguously and give Pakistan only three (3) subjects,
the maximum defence, Foreign affairs and currency till
the final resolution of Jammu Kashmir dispute.
But in the case, too there should be a deputy defense
minister and deputy foreign Minister from PAJK to watch
the interest of the state. The Pakistan shall have keep
her hand off from all other subjects –Health Education,
trade, culture etc, for all shall be dealt with by the
PAJK govt according to its own constitution, which it is
yet to frame. There won’t be a Kashmir Council, Lent
officers, Military commanders to supervise our
Government. And agencies to make and break Govts. We
would like to purge our state of all block-headed,
inefficient, incompetent and corrupt hierarchy, which
has damaged and destroyed their country to the point of
no return. We wish that we should be allowed to run our
affairs at our own without dictation from outside and
without forcing us to go for the last option. But, at
present in this seminar we are going a changes in few
sections of the
Act-1974 in bit moderate way. Which are the following:-

The last bit one paragraph
of the ‘preface’ (page-iii) should finish at
…….
17th June, 1985.’No need to mention 2 names
of those who are known as the institutions of Loot and
plunder in such a basic document of a nation.

Section-2(3):
should be omitted. It is not the business of a state
to interfere in citizen’s faith which is concerned
with hereafter.

Section 3: should
also be omitted. It is ridiculous to ascribe a faith
to a lifeless body like a state. The religion is
me3ant for the people not for the States.

Section-5 (President)-(4)(a):
should be omitted. In 100 percent Muslim Population no
person other than Muslim can claim to become a
President. Then why this unnecessary addition just to
invite criticism.

section -7(2): should
be omitted. It is absolutely irrelevant and idiotic to
demand implementation of UNO’s resolutions, which give
freedom to the people of Jammu Kashmir to vote either
for Pakistan or for India .you Have no right to
restrict it to Pakistan alone; and still claim to be
champions of democracy.

Section-10: Proviso
should be omitted. It amounts to snatch away the
freedom religion from the citizen of the territory.

Section-13(2):
should also be omitted as in case of President

Section -15 to
Justify this section you need to repeal all the
discriminatory laws on the basis of faith an political
ideas.

Section -17: The
words ‘Most senior Minister’ should be properly
defined such as age service or any other qualification
etc.

Section-19(2):
The Act-1974 should be purged of all the Bindings on
the Govt of PAJK except in 3 subjects-defense foreign
affairs and currency and that too till the final
resolution of Jammu Kashmir dispute. This govt should
not be bound by the dictation of the Council, which is
not an institution of Jammu Kashmir for it is headed
by a non state-subject Prime Minister of Pakistan, who
can not become a member of Jammu Kashmir Assembly.

Section-21: there
should be no institution like Council which is not
headed by a state-subject of Jammu Kashmir. There
should be an upper-House- senate at Muxaffarabad.

Section-22:
Legislative Assembly should be superior institution
with all the powers of assemblies in parliamentary
system and should be subservient to any other
institution like Kashmir council. At present its scope
is too limited to be called a legislative assembly.

Section-30: The
quorum should be fixed at 50 percent of the total
membership, while the decision should be made with 2/3
majority of total members, so that such decision could
reflect the reasonable majority of the voters.
-
Section-32: There
should be no Council of Islamic Ideology and the
powers should be vested in the Legislative Assembly
which could consult any religious scholars if need be
for it would reduce a lot of Burden on the public
exchequer.

Section-33: the
proviso of this section should be omitted and
Legislative Assembly should have unlimited powers to
amend this Act.
-
Section-34 the
Kashmir Council should be brought within the
Jurisdiction of higher courts of PAJK.
-
Section-35: the Bill
passed by the council should also require the assent
of the president.
-
Section-42: the
Judges of supreme Court of PAJK should be appointed by
a panel of Legislative Assembly with the consultation
of chief Justice of Supreme and the President. In
case. it is Chief Justice’s appointment., both
prime Minister and president should be consulted, But
council should have nothing to do it.
-
Section-42-E: If at
any time and at any occasion the Supreme Judicial
Council seems partial; the president should have power
to replace it to the extent of partiality.
-
Section-43: The
Judges of High Court should also be appointed by panel
of Legislative Assembly with the consultation of Chief
Justice of Supreme Court and High Court and the
president. In case of appointment of Chief Justice,
with the consultation of Chief Justice of Supreme
Court and the President. Again council should have
nothing to do it.
-
Section-44-A: to make
a clear-cut move to separate judiciary from the
executive courts should have powers to make rules for
the courts of all levels without consultation of govt.
-
Section-46-A: The
decisions of Supreme Court of PAJK should not just be
advisory, but binding on the council and its chairman
as Kashmir Council and chairman of Kashmir Council;
otherwise how a non state-subject can be a ruler of
Jammu Kashmir? Then what was wrong with Maharajah Hari
Singh who was also a state-subject.

Section-56: The
responsibility of Pakistan according to UNCIP;s
direction, id to supervise the separated part of Jammu
Kashmir till its final resolution and not to dictate
and integrate this territory into Pakistan; which she
has doing for the last 60 years. Therefore, this
section should be omitted and Pakistan should be given
only three subjects as has been mentioned in the
preceding lines with some conditions.

Section-57(2):
Courts should have powers to direct the govt.
regarding fundamental Human rights and protection of
Parliamentary structure.

Section-58: If the
President is authorized to make such rules, He should
be directly elected president, and not otherwise.
-
Schedules Regarding Oath:
the incumbent of any office should take oath in the
name of God, But it is a absolutely ridiculous to
recite all the details of one’s faith. Hence these
should be omitted; I that the basic document of the
state become unburdened of irrelevant and unnecessary
details.
Note:
We have not discussed the
details of Subjects assigned to the Legislative Assembly
and Kashmir Council respectively’beacuase all powers at
present we know are vested with Kashmir Council while
Legislative Assembly is very poorly equipped with the
law making powers, especially relating to the finance.
Hence we have recommended Kashmir Council’ abolition,
and a senate in its place>no more or Less.

our "Core Concern"
Islamabad needs to worry
about Kabul, while New Delhi should address Kashmiri
demands
SM KRISHNA has
shown a courage and sagacity that is rare in Indian
politics. Not only has he refused to be drawn into a
slanging match with Shah Mehmood Qureshi, but he has
done what no political leader has done, to my knowledge,
in recent years — take on the powerful Indian
bureaucracy in public and put the blame for the failure
of the talks on the timing of Home Secretary GK Pillai’s
revelation of the ISI’s hand in the 26/11 attacks on
Mumbai.
By accepting a large part of the blame, Krishna has
reopened the way for the resumption of talks between the
two nations. But what can they talk about now? Coming on
top of Ajmal Kasab’s confession, and David Headley’s
admissions to the FBI, and to India’s NIA, the evidence
of continuing ISI complicity with the Taliban has ripped
the veil of ambivalence off the face of the Pakistan
state. They show that even under Pervez Musharraf the
Pakistan army never stopped, and never intended to stop,
using terrorism against India.
The sharp resurgence of separatist sentiment in Kashmir
has also blighted the prospect of peace talks between
the two countries. It has made it next to impossible for
any civilian government in Islamabad to pick up the
threads of the Manmohan–Musharraf backchannel
negotiations from where they were dropped in 2007. The
premise on which these were being held was Musharraf’s
realisation that while Kashmiris wanted azadi, they did
not want to become a part of Pakistan. This made it
possible for both nations to look for a formula that met
the substance of Kashmiri demands without any formal
change of borders. Today, the rising tide of anger in
Kashmir has swept the moderates away. Therefore, it has
become extremely difficult for any Pakistani government
to explain to its own people why it is still prepared to
discuss issues such as the quantum of autonomy, and
inter-Kashmir co-ordination of policies, when so many
Kashmiris are willing to die rather than stay in the
Indian union on any terms.
Must we remain content with talking about talks till the
Americans and NATO start pulling out of Afghanistan,
Pakistan faces the full backlash of the Taliban and Al
Qaeda’s victory, and tries to save itself by redirecting
attention to Kashmir?
The answer is that the path to peace is still not
entirely blocked, but it will require both countries to
abandon the composite dialogue and address each others’
core concerns straightaway. This requires honest
rethinking because Pakistan’s core concern is not
Kashmir but its undemarcated and unaccepted border with
Afghanistan. No Afghan government has ever accepted the
Durand Line. Thus Pakistan’s central concern, especially
after the secession of Bangladesh is the stabilisiation
of its western border. To do this, it has felt it
necessary to have a government in Kabul over which it
has a measure of control. This is what fuels its
paranoid allergy to India’s current influence in
Afghanistan.
Kashmir is India’s, not Pakistan’s core concern. It is
the only Muslim majority part of the country. In 1947,
its dominant political party, the National Conference,
chose not to join Pakistan because it felt that
Kashmiris had a better chance of preserving their
composite culture within a federal, democratic India.
But India has not been able to live up to its promise
because Pakistan has not allowed New Delhi to ever fully
relax its hold on Kashmir. The one thing that Delhi is
able to afford less and less with every passing year is
a communal backlash on Muslims in India because of what
might happen in Kashmir.
Peace and stability in South Asia will only come when
the two countries understand and respect each other’s
core concerns, and agree to address them jointly. The
time for doing this is running out.
UK PNP Condemns such acts
Brussels: The
United Kashmir People's National Party (UKPNP), has
strongly reacted on this news and called upon world
community to come forward to save Kashmiri people and
specially the young school going girls which are
vulnerable and at the target of the personnels of secret
agencies of Pakistan freely and independently and with
dominant
authority residing in the Pakistani Occupied Kashmir.
Issuing a statement from Party's International
secretariat Party president M. Ishaq Khan, General
Secretary Jamil Maqsood, Vice president Sikandar Abbas,
Yasir Younas, Raja Shahid Iqbal, Sajid Hussain and
others have strongly condemned the action of pakistani
secret agents. They said that few years back a Dragger
Group ( Churra Group), was wandering in the area and
they have brutely killed hundred of people, finally they
were caught by the people in Rawalakot and when police
arrested them they were revealed their identification as
members of notorious Pakistani spy agency ISI. They were
taken by the military and there was no trail against
those killers of Pakistani military. Party's Belgium
branch has asked fellow Party units in various countries
to take notice of such terrifying acts and forward it to
the Human rights organizations, Members of the local and
European Parliament so that world community and
international leaders could pressurise Pakistan and its
notorious agencies to stop harassment of our people in
Pakistani Occupied Kashmir.
US Congressmen Call For Resolution of Kashmir
Washington 29
July 2010: The underway youth led, indigenous and
spontaneous movement, non-violent pluralistic and
resilient youth for right to self-determination in
Jammu and Kashmir is at a critical juncture calls upon
the United Nations to ‘lead the effort to achieve a fair
and lasting settlement of the Kashmir dispute’, were the
opening remarks of Dr. Ghulam Nabi at the inaugural
session of the two day Eleventh International Kashmir
Peace Conference organizaied by the Kashmiri American
Council/ Kashmir Centre and Association of Humanitarian
Lawyers in Washington wall.
The conference held in glittering hall of the Cannon
Building in the Capitol Hill was attended by large
number of delegates from India, Pakistan, both the sides
of Jammu and Kashmir, Kashmir Diaspora from all over the
world, United State’s thinks, Congressmen, diplomats
from various countries stationed in Washington D.C.,
prominent US columnists and opinion makers.
Congress men who spoke at the inaugural function
included Congressman Dan Burton, Congressman Alderholt,
Cingressman Danny Davis, Congressman, Dannis Kuchinich,
Congressman Yvette Clark and Congressman Joseph Pit. The
Congressmen expressing their deep concern and
dissatisfaction over the situation prevailing in trouble
torn Jammu and Kashmir called upon ending the
persecution of people in the state and respecting human
rights in the state. They called upon India and Pakistan
to resolve the Kashmir dispute to the urges and
political aspirations of people of Jammu and Kashmir
without causing any further suffering to people in the
state. The Congressmen were unanimous in their approach
that for bringing peace in South Asia the resolution of
Kashmir dispute has become imperative. Some of the
Congressmen said the President Obama was fully aware
about the importance of Jammu and Kashmir for peace and
stability not only in Afghanistan but for entire south
Asia.
Highlighting the objectives for the Conference Dr. Fai,
was to achieve the peaceful resolution of the Kashmir
dispute through peaceful dialogue between all parties
concerned and to do so in the spirit of reconciliation,
not confrontation, equality, not discrimination; hope,
not despair.
Mr. Hussein Haqani, Ambassador Huessin Haqani Ambassador
of Pakistan speaking on the occasion reaffirmed the
policy of Pakistan government of supporting Kashmir
struggle for right to self-determination, morally,
politically and diplomatically. Others who spoke at the
inaugural and emphasized for renewing efforts at all
levels for finding solution of the Kashmir problem in
sync with the internationally laid out principles
included Ms. Victoria Schofield, Mrs. Rita Manchandi,
Mr. Ved Bhasi and Amb: Maleeh Lodhi.
The first technical session of the conference India-
Pakistan Relations: Breaking Deadlock was presided over
by Author and Columnists Zahid G Muhammad, those who
made their presentations in this session included Mr.
Kuldin Nayar, Former Indian High Commissioner, in the
UK, Mr. Muhammad Afzal Sindhu, State Minister, Law and
Justice Govt of Pakistan, Prof. Stanely Wolpert,
Historan, Senator Mushahid Hussain Syed and Ambassador
Yousuf Buch.
The consensus that evolved at this session was that the
people of Kashmir suffering for India and Pakistan
remaining caught in the web of the blame game and there
was need for moving beyond the blame game and resumption
of composite dialogue between two countries and holding
Kashmir focused dialogue involving people of Jammu and
Kashmir.
The second Techencial Session titled The Impasse over
Kashmir was presided by Mr. Ejaz Sabir, Attorney at
Law. Those who made their presentations in this session
included Dr. Karen Parker, UN Delegate, Intl.Ed.
Development, Dr. Attiya Inaytullah, Member Pakistan
National Assembly, Zahid G Muhammad. Author and Writer,
Prof. Angana Chateerji and Dr. M.A. Dar, Ohio
The Time Correspondent who was recently in Srinagar
exhibited a small documentary on recent developments on
Kashmir during the session.
The third session on Kashmir Issue: Its impact on
Regional and International Security was Presided over by
Barristor Sareer Fazili Esq. Those who made their
presentation at this session included Amb: Munir Akram,
Former Ambassador of Pakistan to UN. Justice Rajinder
Sachar, Dr. Rodeny Jones, M. Ahmed Bilal Sufi Presideny
Ressearch Society.
